Dealer ordered to refund car buyers

KANGAR: The Consumer Claims Tribunal today ordered car seller Laytac Auto Sdn Bhd to return deposits of RM500 each to two buyers who cancelled their booking. 

Tribunal president Pretam Singh gave an order after hearing the claims of trader Shabaren Shafeei, 33, and electrician Md Surizan Md Salleh, 31.

He also directed the refund to be made within fourteen days.

Shabaren, from Chuping near here, said he'd cancelled a booking for a Perodua Viva 850 that he made on Aug 11 last year after he failed to get a financial loan.

He requested to get a refund however the company didn't return to him, Shabaren said in his statement of claim. Md Surizan, from Simpang Empat, said the company didn'tdeliver a car of the colour he specified in his booking on Dec 11, 2010.

The firm also failed to set a delivery date, and did not give him back his money even though it had promised to do so.

Pretam Singh said there were "unfair terms" in a car purchase contract which did not state the date of delivery. Another claimant, Hasanuddin Abdul Salam, 48, from Jitra, Kedah, withdrew his claim against the company, saying that the case had been resolved through consultations.

Hasanuddin booked a Perodua Alza and paid a RM500 deposit in February but the company failed to find a seller to buy the Perodua Myvi that he wanted to trade in. He requested a refund and agreed to settle for RM300 of the amount he paid.
